Abstract

Difficult to find a halal or haram, then the halal label for packaged food products is important for the Muslim consumer protection, because the presence of the label halal Muslim consumers can choose the product that is lawful, and in relation thereto, the Government has established regulations that associated with halal label, but the problem is: 1. whether the legislation which manages the kosher label has provided protection against Muslim consumers, and 2. whether the cause of entrepreneurs have not labeled halal in packaging products, while the goals to be achieved are: 1. to identify and analyze the legislation that manages halal label in providing protection against Muslim consumers, 2. to reveal the factors that cause businesses not included in the packaging label kosher products.This study uses normative legal, normative research is done through the study of literature and the informant obtained from the Head of the Food and Drug Monitoring Agency (BPOM) of Pontianak, Chairman Ulema Council in Pontianak in West Kalimantan, Head of Industry and Trade of Pontianak. Based on the research results, it can be seen: 1. That the conditions governing the issue of halal label is not set in the rules that specifically regulate the halal label, but scattered in various laws and regulations governing the kosher label has not been able to provide consumer protection laws against Islam in Indonesia, because the provision of halal labeling on a product included in the packaging of food products is not an obligation, but only voluntary business actors (producers), 2. that the factors that cause businesses (manufacturers) in food packaging not labeled halal is more oriented manufacturers to benefit as much as possible with the least possible expenditure, while the labeling of halal producers have to incur huge costs to bear a series of studies regarding the halal products, and ultimately lead to higher production costs.
